PictoWave is an independent third-party product designed to be compatible with the AAX format; it is not developed, published, distributed, warranted, approved or sponsored by Avid Technology, Inc. Third-party trademarks and other third-party materials remain the property of their respective owners.
PictoWave is licensed, not sold, by the Publisher under the End-User License Agreement ("EULA"), which is accepted during installation. The purchase transaction is entered into with Sold through Link, LLC f/k/a Lemon Squeezy LLC ("Lemon Squeezy"), acting as authorized reseller and Merchant of Record, in accordance with its Buyer Terms. The PictoWave Commercial Terms describe the offer and the Publisher's own commitments. Purchasing a license does not transfer any intellectual property rights in the Software, subject to the rights applicable to third-party and open-source components described in the EULA.
The processing of personal data in connection with the Site, the Software, license management, activation, the trial period, update checks, diagnostics, support and the newsletter is described in the PictoWave Privacy Policy. Processing carried out by Lemon Squeezy in connection with the purchase transaction is governed by the privacy information it provides.
The Site uses Plausible Analytics for audience measurement without cookies or persistent identifiers. Technical mechanisms strictly necessary for the operation of third-party services, including the Lemon Squeezy checkout, are governed by the terms and policies applicable to those services. Please refer to the PictoWave Privacy Policy for further information.
The Publisher uses reasonable efforts to keep the information on the Site accurate and up to date, without guaranteeing that it will at all times be complete or error-free. To the extent permitted by law, the Publisher is not responsible for damage resulting exclusively from use of the Site contrary to its intended purpose, an interruption or unavailability beyond its reasonable control, or content on third-party websites accessed through links. The terms applicable to the Software, the license and the Publisher's liability are set out in the EULA and the Commercial Terms, without prejudice to any rights or liabilities that cannot legally be excluded or limited.
Where a consumer dispute arises directly between a Customer acting as a consumer and the Publisher, the consumer must first submit a written complaint to the Publisher. If the dispute is not resolved amicably, the consumer may refer it, free of charge, to the consumer mediator appointed by the Publisher:

The Site and this Legal Notice are governed by French law. Contractual relationships relating to the purchase and use of PictoWave remain governed by the contractual documents applicable to them, including Lemon Squeezy's Buyer Terms, the PictoWave Commercial Terms and the EULA. Any dispute shall be brought before the courts having jurisdiction under applicable law, without prejudice to any mandatory consumer-protection or jurisdiction rules applicable to a consumer.
In the event of a discrepancy between translations, the French version prevails.
